As an applicant for an IGFF Grant, I understand and acknowledge the following: A financial hardship is an unplanned and unforeseen financial expense that is beyond my means to manage. It is a life changing event that alters my day-to-day and is not solely due to loss of employment. I understand examples that are likely to be granted are often centered around providing relief that is restorative; enabling me to get as close as possible back to normalcy, such as cost of repairs for an automobile accident, or the cost of my medical expenses the directly deviate from my unforeseen hardship. Additionally, I understand requests which often are not awarded are ongoing expenses that are reasonably expected or expenses that do not directly affect me. For example, this may include cost of rent if I have decided to live beyond my means, medical bills arising because I have chosen not to have medical coverage or expenses that are incurred by anyone other than myself.

1. Capacity. Participant represents that he or she is 18 years old or older and otherwise has the legal capacity to enter into this Publicity Release (the “Agreement”) and grant all of the rights granted in it.

2. Grant of Rights. For good and valuable consideration, the receipt and legal sufficiency of which is hereby acknowledged, Participant hereby irrevocably grants to Insight Global Family Foundation (“IGFF”) and its affiliates and their successors, assigns, and licensees the unrestricted right (but not the obligation) to: (a) use Participant's name, image, voice and likeness in connection with any photographs or videos taken by IGFF on the Filming Date(s) (the “Media”) in any manner, in whole or in part, severally or in conjunction with other works, in any media now or hereinafter known, throughout the universe, in perpetuity, for any lawful purpose whatsoever, including, without limitation, for promotion, advertisement, and trade; and (b) edit, change, or alter the Media without restriction. Participant agrees that the his or her appearance in the Media (the “Performance”) will be considered a work-made-for hire for IGFF, and therefore, IGFF shall be the author and exclusive copyright owner thereof for all purposes throughout the universe. If the foregoing does not operate to fully vest in IGFF any or all of the rights in the Media and the Performance, Participant hereby irrevocably grants, transfers, sells and assigns to IGFF, its successors, assigns and licensees, all present and future right, title and interest of every kind and nature whatsoever in the Performance, including, without limitation, all copyrights and all rights in and to the Media and Performance (including, without limitation, all derivative rights and any and all other ownership and exploitation rights now or hereafter recognized in any territory) for exploitation throughout the universe, in perpetuity, by and in any and all media, devices, processes and technology now known or hereafter devised for any purpose. Participant understands and agrees that he or she will not be paid any money for the rights granted hereunder. Participant hereby waives any right to inspect or approve any use of the Media. Participant confirms that to the best of Participant's knowledge any statements made by Participant in or in connection with the Media will be true and will not violate or infringe upon any third party's rights.

3. Release. Participant releases and waives, and agrees not to bring at any time in the future, any claims or demands against IGFF or its affiliates or their successors, assigns, or licensees, arising out of or relating to their use of the Media, including, without limitation, assertions of (a) rights of publicity (including any allegedly improper or unauthorized use of Participant's name, likeness or image); (b) rights of privacy; (c) presenting Participant in a false light (including any allegedly false or misleading portrayal of Participant); (d) copyright, trademark, or other intellectual property infringement; (e) defamation, libel, or slander; (f) breach of alleged moral rights; or (g) any other claimed violation of a personal or property right.
